USCIS to Resume H-1B Premium Processing for Certain Cap-Exempt Petitions

On July 24, 2017, Department of Homeland Security, U.S. Citizenship and Immigration Services (USCIS) announced it will resume premium processing for certain cap-exempt H-1B employment petitions effective immediately.

Premium processing will resume for petitions that may be exempt from the cap if the H-1B petitioner is: (1) an institution of higher education; (2) a non-profit related to or affiliated with an institution of higher education; (3) or a non-profit research or governmental research organization. In addition, premium processing will also resume for petitions that may also be exempt, if the H-1B beneficiary will be employed at a qualifying cap-exempt institution, organization or entity.
